1. Introduction

Welcome to Axolab Pharmaceuticals Private Limited, referred to as APMEDCARE. These terms govern the use of the website, mobile application, and related services. By using the platform, users agree to these terms.

References to ‘we’, ‘us’, and ‘our’ mean APMEDCARE and its affiliates. ‘You’ or ‘user’ means any person using the platform. ‘Services’ include the website, mobile application, pharmacy, lab services, telemedicine, loyalty programmes, and related offerings.

3. Eligibility

Users must be at least 18 years old to use the services. If the platform is used on behalf of a business or legal entity, the user represents that they have authority to bind that entity.

4. Use of Services

Services may only be used for lawful purposes and in compliance with applicable laws. Unauthorised activities such as scraping, hacking, harmful distribution, fraud, impersonation, or misleading conduct are prohibited.

5. User Responsibilities

Users must provide accurate information while creating accounts or placing orders. Misuse of promotional offers, referral programmes, or discounts may lead to suspension or permanent restriction.

6. Prescription-Based Orders

Valid prescriptions must be uploaded where required for medicines. APMEDCARE may verify prescriptions before order processing and may cancel orders if prescriptions are invalid or fraudulent.

7. Loyalty & Rewards Program

Points earned under programme tiers such as Platinum, Gold, or Silver remain subject to separate loyalty rules. Points are not exchangeable for cash, and the company may modify or discontinue the programme.

8. Orders & Payments

Product and service pricing or availability may change without notice. APMEDCARE reserves the right to refuse or cancel orders suspected to involve fraud or unauthorised transactions. Refunds and cancellations follow the stated policy.

9. Cancellation, Refund & Returns Policy

Orders may generally be cancelled before dispatch. After dispatch, cancellation may not be possible. Eligible refunds may be processed within 7 business days. Returns are not accepted for temperature-sensitive products, perishable items, or opened medicine packs.

10. Intellectual Property

All platform content, trademarks, logos, and materials belong to APMEDCARE or its licensors and are protected by law. Users may not copy, distribute, or commercially use that content without written permission.

11. Third-Party Services

The platform may include links or integrations with third-party services. APMEDCARE does not accept responsibility for the accuracy, policies, or practices of those third parties.

12. Limitation of Liability

APMEDCARE aims to provide accurate and reliable services but does not guarantee uninterrupted access or error-free operation. It is not liable for direct, indirect, incidental, or consequential damages arising from platform use.

13. Indemnification

Users agree to indemnify and hold APMEDCARE harmless from claims, liabilities, or damages arising from violations of these terms or misuse of the platform.

14. Termination

Access to services may be suspended or terminated if a user violates these terms or engages in harmful activities.

15. Service Availability & Downtime

APMEDCARE aims to keep the platform available but does not accept responsibility for unexpected downtime, maintenance windows, or technical failures.

General health information available on the website or app is not a substitute for professional medical advice. Users should consult qualified healthcare professionals before making health decisions.

17. Data Privacy & Security

User data is handled in line with the Privacy Policy. Personal information is not shared without consent except where required by law, and financial transactions are stated to be secured through encrypted payment gateways.

18. Force Majeure

APMEDCARE is not liable for failures or delays caused by events beyond reasonable control, including natural disasters, government restrictions, cyberattacks, supply-chain disruption, or similar events.

19. Governing Compliance

The business states that it complies with the Drugs & Cosmetics Act, 1940, the Information Technology Act, 2000, and relevant data-protection obligations. Disputes are to be handled under Indian legal jurisdiction.

20. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of India. For the refreshed website copy, jurisdiction is presented as courts in Nagpur, Maharashtra, India, aligned with the company address shown on the legacy site.

21. Changes to These Terms

APMEDCARE may update these Terms & Conditions from time to time, and updated versions may be posted on this page with the revised date.

22. Account Suspension & Termination Policy

Accounts may be terminated or restricted for policy violations, fraudulent activity, misuse of services, or repeated invalid refund requests.
